5113.02 - SCHOOL CHOICE OPTIONS PROVIDED BY THE NO CHILD LEFT BEHIND ACT
Persistently Dangerous Schools
If a student is attending a school within the District that has been designated as "persistently dangerous" or has become the victim of a violent criminal offense, as determined by Michigan law, while in or on the grounds of the school that the student is assigned to attend, such student shall be allowed to attend another school within the District that is not persistently dangerous, provided there is a school in the District that offers instruction at the student’s grade level and such school has not been identified as being in the process of school improvement, corrective action, or restructuring.
Within ten (10) days after a school in the District has been designated as "persistently dangerous" by the State Board of Education, the Board will provide students and parents with notice of such designation and offer students the opportunity, at least fourteen (14) days before the beginning of the upcoming school year, to transfer to a safe school within the District beginning at the start of the next school year.
If a student elects to be transferred to a safe school, the Board will make reasonable efforts to transfer the student within thirty (30) days. Such transfer will be in effect as long as the student’s original school is designated as persistently dangerous. Although the transfer will be temporary in nature, a student may be permitted to complete his/her education through the highest grade level at the receiving school. In making its decision, the Board will consider the educational needs of the student, including the student’s ability to succeed if returned to the original school.
Victim of Violent Crime
If student is identified as the victim of a violent criminal offense, as determined by Michigan law (i.e., the student has been identified as the victim and the perpetrator has plead guilty to or been adjudicated or convicted of a violent criminal offense in Michigan court), s/he will be provided notice of the opportunity to transfer to another school within the District that is not persistently dangerous and has not been identified as being in the process of school improvement, corrective action, or restructuring. Such notice shall be provided prior to the start of the next school year.
