STANDARDIZED TESTING FOR SPECIAL EDUCATION STUDENTS

2623A - STANDARDIZED TESTING FOR SPECIAL EDUCATION STUDENTS

When the School Corporation administers standardized tests including State Board-approved statewide achievement tests or end of course assessments, a student who is a child with a disability shall be tested according to the requirements of I.C. 20-32-5.1-11 with appropriate accommodations in testing materials and procedures unless the individuals who develop the child's individualizededucation program (IEP), service plan, choice special education plan, or Section 504 plan determine that testing, or a part of the testing, is not appropriate for the student and that an alternate assessment will be used to test the student's achievement.

Not later than February 1, 2021, and not later than February 1, 2022, each school in the Corporation shall, at the annual review of the student's IEP, service plan, choice special education plan, or Section 504 plan: 1) provide the notice developed by the State Department of Education in consultation with The Arc of Indiana (ARC) and the Indiana Council of Administrators of Special Education (ICASE) to the parent of a student with a disability enrolled in grade three (3), four (4), or five (5) who has an accommodation that is provided as part of the student's IEP, service plan, choice special education plan, or Section 504 plan that the student is not allowed to use on all or part of the statewide assessment informing the parent that the student is not allowed to use the accommodation on all or part of the statewide assessment; and 2) discuss and determine whether the student may be eligible to opt-out of any applicable section of the statewide assessment. If a parent does not attend the annual review, the school shall provide a copy of the notice to the parent by certified mail or personal delivery.

Any decision with regard to the student participating in testing, receiving accommodations in testing materials and procedure, participating in remediation, or being retained at the same grade level for the next school year shall be made in accordance with the child's IEP, service plan, choice special education plan, or Section 504 plan, subject to the State Board-approved statewide achievement test program manual, and Federal law.
