4419.03 - PATIENT PROTECTION AND AFFORDABLE CARE ACT

The Board acknowledges that the Patient Protection and Affordable Care Act (“ACA”) imposes certain obligations upon the District. Such obligations may include the actions listed below.

  1. The District shall notify new employees of health insurance options available through the Health Insurance Marketplace within fourteen (14) days of an employee’s employment start date. Such notice shall be consistent with the sample notice language provided by the U.S. Department of Labor.
  2. Employees of the District have the option to enroll in the Health Insurance Marketplace. If a full-time employee (as defined by the ACA) of the District enrolls in the Health Insurance Marketplace and receives a subsidy, then the District may be liable for a penalty.

    Inthe eventthe District concludes that it is fiscally advantageousto incur the potential penalty in lieu of providing affordable, minimum value coverage to all full-time employees, the District shall incur the potential penalty.
