7510.001 - PUBLIC ACCESS TO RUBICK FIELD AND STEINBECKER FIELD

The Board of Education believes that Rubick Field and Steinbecker Field (the “Athletic Fields”) should be made available to the public for the public’s use and enjoyment, provided that such use does not interfere with use for school purposes, by school-related groups, or for school-related functions, and that such public use does not interfere with the District’s duty to ensure the maintenance and security of District owned buildings and facilities. This policy is intended to balance the interest of the public in the use and enjoyment of the Athletic Fields, against the District’s obligations for maintenance, safety and security.

The Board of Education will not permit access to any District-owned buildings or facilities at the Athletic Fields, which shall include (but is not necessarily limited to) restrooms, locker rooms, storage facilities, press box(es), offices, concessions facilities, box office, maintenance offices, unless the use of any such improvements has been authorized pursuant to Board Policy 7510—Use of District Facilities.

Subject to the exceptions below, the Board of Education will generally permit public access to open areas of the Athletic Fields, which shall include (but is not necessarily limited to) the football field, track, baseball/softball diamonds, practice fields between the hours of 7:00 a.m. and 7:00 p.m., Monday through Friday.

Exceptions

Notwithstanding the above, the Board of Education reserves the right to prohibit public access to the open areas of the Athletic Fields as follows:

  1. During school-related functions;
  2. During uses of the Athletic Fields as authorized pursuant to Board Policy 7510—Use of District Facilities;
  3. As necessary to enforce the provisions of Board Policy 7440—Facility Security;
  4. Federal holidays that school is not in session;
  5. Such times as is necessary to ensure the maintenance, safety and security of District facilities;
  6. As may be directed by the Manitowoc Police Department or other City of Manitowoc authorities.

The Superintendent shall have the discretion to reasonably apply the exceptions above, and shall develop further administrative guidelines as necessary for the application and enforcement of these exceptions, which guidelines shall include:

  1. Signage informing public of open hours;
  2. Securing the Athletic Facilities during off hours;
  3. Circumstances under which public access shall be further limited pursuant to Board Policy 7510, 7440, or to ensure the maintenance, safety and security of District facilities;
  4. Method of informing public when public access will be limited pursuant to Board Policy 7510, 7440, or to ensure the maintenance, safety and security of District facilities;
  5. Public users shall be financially liable for damage to the Athletic Fields.

No liability shall attach to the District, any employee, officer or member of this District specifically as a consequence of permitting access to the Athletic Fields.
