0142.1 - ELECTORAL PROCESS

Board elections are held during at the spring election on the first Tuesday in April in a manner that is consistent with State law.
      
The term of office for elected Board members shall be for three (3) years, except as otherwise provided. The term of office shall begin on the fourth Monday in April following the date of his/her election.

           
A Board member shall be elected when the term of an existing member expires at the annual election in April.

           
The make-up of the Board of Education shall be from various geographical divisions of the District. The geographical representatives shall be on the following basis:

  1. Two (2) members from the area comprising the City of Durand and the Town of Durand to be designated as Area I.
  2. One (1) member from the area comprising the Towns of Albany, Peru and Rock Creek to be designated as Area II.
  3. One (1) member from the area comprising the Town of Lima and Sections 7, 8, and 18 of the Town of Canton to be designated as Area III.
  4. One (1) member from the area comprising the Towns of Maxville, Nelson, Modena, and Section 19, 29, 30, 31 and 32 of the Town of Canton, and the Village of Nelson to be designated as Area IV.
  5. One (1) member from the area comprising the Town of Dunn, Eau Galle, Waubeek and Waterville (that area that was part of the Durand-Arkansaw School District as of 11/5/91) to be designated as Area V.
  6. One (1) member from the area comprising the Town of Frankfort and Waterville (that area that was part of the School District of Arkansaw as of 11/5/91) to be designated as Area VI.

Declaration of Candidacy

Any qualified elector desiring election to the Board must file a Declaration of Candidacy with the Board Clerk, using forms provided by the District, no later than 5:00 P.M. on the first Tuesday in January. Qualified candidates shall then be placed on the ballot.

Incumbent Board members may file a Declaration of Non-Candidacy by 5:00 P.M. on the 2nd Friday preceding the deadline for filing ballot access documents, as specified in the preceding paragraph, to avoid an extension of time for filing such papers.

If an incumbent fails to file a Declaration of Candidacy by the 5:00 P.M. deadline on the first Tuesday in January, candidates may file a Declaration of Candidacy within seventy-two (72) hours following the original Tuesday deadline.

The order of names on the ballot shall be determined by lot, in the event more than one (1) person seeks office from a representative area.

Declaration of Non-Candidacy

If an incumbent files a Declaration of Non-Candidacy no later than 5:00 P.M. on the 2nd Friday preceding the Tuesday deadline, there is no extension of the Tuesday deadline.

When the first Tuesday in January is a holiday the deadline becomes 5:00 P.M. the next day.

In addition, if an incumbent files written notification that the incumbent is not a candidate for reelection to their office or fails to file a declaration of candidacy within the time prescribed by this bylaw, the District Clerk shall promptly provide public notice of that fact on the District's website or, if the District does not maintain a website, by posting notices in at least three (3) different locations within the District.
