8475 - CRIMINAL BACKGROUND CHECK FOR NON-DISTRICT PERSONNEL

Disqualification from Eligibility

A person is ineligible to volunteer in a Brevard Public School, if the person has been convicted of ANY felony offense prohibited under any of the following statutes:

Convicted is defined as a judicial finding of guilt, a plea of guilty, a plea of nolo contender or entering into a pre-trial intervention program, whether or not there is a formal adjudication of guilt or if the case has been dissolved or expunged.

  1. Sexual misconduct with certain developmentally disabled clients - F.S. 393.135
  2. Sexual misconduct with certain mental health patients - F.S 394.4593
  3. Abuse, neglect, or exploitation of aged persons or disabled adults - F.S. 415.111
  4. Murder - F.S. 782.04
  5. Manslaughter - F.S 782.07
  6. Aggravated assault - F.S. 784.021
  7. Aggravated battery - F.S. 784.045
  8. Battery on a detention or commitment facility staff member or a juvenile probation officer - F.S. 784.075
  9. Kidnapping - F.S. 787.01
  10. False imprisonment - F.S. 787.02
  11. Luring or enticing a child - F.S. 787.025
  12. Leading, taking, enticing, or removing a minor beyond the state limits, or concealing the location of a minor, with criminal intent pending custody proceedings - F.S. 787.04(2)
  13. Leading, taking, enticing, or removing a minor beyond the state limits, or concealing the location of a minor, with criminal intent pending dependency proceedings or proceedings concerning alleged abuse or neglect of a minor - F.S. 787.04(3)
  14. Exhibiting firearms or weapons at a school‐sponsored event, on school property, or within 1,000 feet of a school - F.S. 790.115(1)
  15. Possessing an electric weapon or device, destructive device, or other weapon at a school-sponsored event or on school property - F.S. 790.115(2) (b)
  16. Sexual battery - F.S. 794.011
  17. Sexual activity with or solicitation of a child by a person in familial or custodial authority - F.S. 794.041
  18. Sexual activity with certain minors - F.S. 794.05
  19. Female genital mutilation - F.S. 794.08
  20. Lewdness and indecent exposure - F.S. Chapter 800
  21. Voyeurism - F.S. 810.14
  22. Video voyeurism – F.S. 810.145
  23. Coordinating the commission of theft in excess of $3,000 - F.S. 812.014(6)
  24. Theft from persons sixty-five (65) years of age or older – F.S. 812.0145
  25. Dealing in stolen property – F.S. 812.019
  26. Robbery – F.S. 812.13
  27. Robbery by sudden snatching - F.S. 812.131
  28. Carjacking - F.S. 812.133
  29. Home Invasion Robbery – F.S. 812.135
  30. Fraudulent Sale of controlled substances – F.S. 817.563
  31. Abuse, aggravated abuse, or neglect of an elderly person or disabled adult – F.S. 825.102
  32. Exploitation of an elderly person or disabled adult – F.S. 825.103
  33. Lewd or lascivious offenses committed upon or in the presence of an elderly person or disabled person - F.S. 825.1025
  34. Incest – F.S. 826.04
  35. Child abuse, aggravated child abuse, or neglect of a child – F.S. 827.03
  36. Contributing to the delinquency or dependency of a child - F.S. 827.04
  37. Sexual performance by a child - F.S. 827.071
  38. Extortion – F.S. 836.05
  39. Resisting arrest with violence – F.S. 843.01
  40. Obscenity – F.S. 847
  41. Causing, encouraging, soliciting, or recruiting another to join a criminal street gang – F.S. 874.05
  42. Drug abuse prevention and control, if the offense was a felony of the second degree or greater – F.S. 893
  43. Sexual misconduct with certain forensic clients and reporting of such sexual misconduct – F.S. 916.1075
  44. Introduction/removal/possession of contraband at a correctional facility – F.S. 944.47
  45. Sexual misconduct in juvenile justice programs – F.S. 985.701
  46. Introduction/removal/possession of contraband at a juvenile detention facility or commitment program - F.S. 985.711
  47. Arson - F.S. 806.01

WILL NOT APPROVE – If offense is less than ten (10) years old.  The Office of District Security will consider and carefully review if the conviction date is older than ten (10) years.

Felony Battery/Assault (on Board employee or law enforcement officer)

Felony Drug Use – Third Degree Felony only

Possession of a Concealed Weapon – Felony or Misdemeanor

Forgery

Grand Theft

Prostitution

Solicitation of Prostitution

WILL NOT APPROVE – If offense is less than five (5) years old.  The Office of District Security will consider and carefully review if the conviction date is older than five (5) years.

Assault

Battery

Battery – Domestic Violence

Felony Drug Use

Drug Possession – Misdemeanor

Paraphernalia Possession – Misdemeanor

Resisting or Opposing an Officer with Violence (RAOWV)

Sale of Alcohol or Tobacco to a Minor

CASE-BY-CASE REVIEW

Disorderly Conduct

Trespass

Petit Theft

Worthless Checks

DUI – 1st Offense Only

Multiple Arrests

Other Criminal Traffic Offenses

Other Crimes

PENDING CHARGES

Candidates with pending charges will be placed in a suspended status until the criminal case has been judicially closed.  Candidates with pending misdemeanor traffic offenses may be reviewed at the discretion of the District based upon the nature of the charge. 

PROBATION

Candidates currently on probation will not be cleared until all sanctions are complete and documentation from the courts stating probation has ended.
