2623E - SPECIAL TESTING ACCOMMODATIONS FOR STUDENTS CLASSIFIED AS DISABLED AS DEFINED BY SECTION 504
To assure that all qualified students with a disability in our public education system are provided necessary related aids, services, or accommodations during the administration of the test, districts will ensure that students with a disability who are not currently in any special education program or who do not have a current IEP can be considered for and, if appropriate, provided test accommodations. Those students who are not classified as exceptional students with active IEP’s may qualify as persons with a disability as defined in Rule F.A.C. 6A-19.001(6), and Section 504 of the Rehabilitation Act of 1973. Rule F.A.C. 6A-19.001(6) defines a person with a disability as:
Any person who has a physical or mental impairment which substantially limits one or more major life activities; has a record of such an impairment; or is regarded as having such an impairment.
- Physical or mental impairment
- Any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the following body systems: neurological; musculoskeletal; special sense organs; respiratory, including speech organs; cardiovascular; reproductive, digestive, genito-urinary; hemic and lymphatic; skin; and endocrine; or
- Any mental or psychological disorder, such as intellectual disabilities, organic brain syndrome, emotional or mental illness, and specific learning disabilities.
- Major life activities
Functions such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning and working. - Has a record of such an impairment
Has a history of, or has been incorrectly classified as having, a mental or physical impairment that substantially limits one (1) or more major life activities. - Is regarded as having an impairment.
- Has a physical or mental impairment that does not substantially limit major life activities but that is treated by an institution as constituting such a limitation;
- Has a physical or mental impairment that substantially limits major life activities only as a result of the attitudes of others and, therefore, is treated by an institution as having such an impairment.
A student who is determined by the School District to have a physical or mental impairment under these requirements is eligible for modified testing conditions if it is determined that the student’s impairment of sensory, manual, or speaking skills interferes with the performance on the test. School District personnel will determine which of the accommodations listed above are appropriate for each student who is determined disabled as defined in Rule F.A.C. 6A-19.001(6), as documented on a Section 504 Accommodation Plan.
